1. Who we are

This website, hale-air.com, and the Hale store are operated by Aivarise VOF, registered with the Dutch Chamber of Commerce (KVK) under number 42146069. "Hale", "we", "us" and "our" refer to Aivarise VOF trading as Hale.

2. These terms

These terms apply when you use our website or place an order with us. By using the site or ordering, you agree to them. Please read them before you order.

3. Using the website

Hale is marketed and sold to adults aged 18 and over. By ordering, you confirm that you are 18 or over.

You may use the site for lawful personal purposes only.

4. Our products

Hale is a reusable, airflow-based flavour device. It contains no nicotine and no tobacco, produces no smoke, and has no battery or electronics.

Hale is not marketed as a medicine or smoking-cessation treatment, and we make no health, therapeutic or reduced-risk claims for it.

We try to describe and photograph our products accurately. Colours can vary between screens, and photographs are illustrative.

5. Prices and payment

All prices are shown in euro (EUR). The total price payable will be shown before you place your order, including applicable taxes and charges that Hale is required to collect. Shipping is free — see our Shipping Policy.

We may change prices at any time, but the price that applies to your order is the price shown when you place it. Payment is taken through our payment provider at checkout.

6. Orders

When you place an order you are making an offer to buy. We will send you an order confirmation by email.

We may decline or cancel an order — for example where an item is unavailable, where there has been a pricing or description error, or where we reasonably suspect fraud or misuse. If we cancel an order you have already paid for, we will refund you in full.

We may also limit order quantities.

7. Availability

Products are subject to availability. We may change or discontinue products at any time.

8. Shipping and delivery

Delivery timescales, dispatch arrangements and charges are set out in our Shipping Policy, which forms part of these terms.

9. Cancellation, returns and refunds

Your right to cancel, how to return an item and how refunds work are set out in our Returns & Refunds Policy, which forms part of these terms. Your statutory rights as a consumer are not affected.

10. Acceptable use

You must not use our site or products unlawfully, attempt to gain unauthorised access to our systems, interfere with the site's operation, resell our products without our written agreement, or submit false or misleading information.

11. Intellectual property

The Hale name, logo, site content, text, photography, video and product design are owned by us or our licensors. You may not copy, reproduce, distribute or create derivative works from them without our written permission.

12. Third-party services and links

Our site uses third-party services, including our ecommerce platform, payment provider and fulfilment partner, and may link to other websites. We are not responsible for the content or practices of third-party sites, and their terms and privacy policies apply to your use of them.

13. Errors and inaccuracies

Occasionally information on the site may contain errors or omissions relating to descriptions, pricing, promotions or availability. We may correct any error and, where an order is affected, cancel it and refund you.

14. Our responsibility to you

We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill.

We do not exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for anything else that cannot lawfully be excluded — including your rights in relation to faulty or misdescribed goods.

We are not liable for business losses. If you use our products for any commercial purpose, we have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.

15. Consumer rights

Nothing in these terms affects the mandatory consumer protections that apply to you under the law of the country where you live. Where anything in these terms conflicts with those protections, those protections apply.

16. Complaints

If something has gone wrong, email contact@hale-air.com and we will work with you to resolve it. If we cannot resolve a complaint between us, you may be entitled to use an alternative dispute resolution scheme, or to seek assistance from the consumer protection body or European Consumer Centre in your country.

17. Changes to these terms

We may update these terms. The version published on this page at the time you place an order is the version that applies to that order.

18. Governing law

These terms are governed by the law of the Netherlands, where Aivarise VOF is established. This does not deprive you of the protection of the mandatory consumer law of the country where you habitually reside, and you may bring proceedings in the courts of that country.
